Why Year-Round Tax Planning Matters

Here’s some good news for California business owners: beginning in 2026, businesses that miss or underpay the required June 15 PTE payment may still be eligible to make the PTE election.

Under the previous rules:

  • Missing the June 15 PTE payment generally meant losing eligibility for the election for that tax year

Starting in 2026 through 2030:

  • Businesses may still make the PTE election even if the June 15 payment is missed or underpaid
  • The available PTE tax credit may be reduced rather than completely lost
  • The reduction is 12.5% of the qualified taxpayer’s pro rata share of the unpaid required June 15 payment

This change provides additional flexibility and may allow taxpayers who missed the June payment deadline to still benefit from the PTE election. It also demonstrates how tax laws continue to evolve, creating new opportunities for business owners.
